Terms and conditions
Terms and conditions of use
Art.1 SCOPE OF AGREEMENT
Unless otherwise agreed in writing, orders are governed without exception by the general terms and conditions of sale below, which prevail over any other stipulation or documents from our customers. These general terms and conditions of sale apply exclusively to current and future commercial relations between PARICI, a sole proprietorship, whose registered office is located at 52 rue Mouffetard 75005 PARIS, registered in the Paris Trade and Companies Register under number 398 805 457, hereinafter referred to as PARICI and the author of the order, hereinafter referred to as the Customer. Any order placed by the customer implies their unconditional and unreserved acceptance of these general terms and conditions of sale.
Art.2 PRICES
Art.3 PRODUCTS
The photos of the items shown on the PARICI website are not contractual and may be modified at any time upon simple request of the manufacturer. Similarly, the products available on the PARICI website are covered by the legal guarantees of their respective manufacturers.
Art.4 ORDERS
The most common ordering method is online at: www.souvenirparis.com.
The customer can also order by telephone every day from 10:00 a.m. to 7:00 p.m. at 01.43.31.79.85 (cost of a local call).
PARICI reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order.
Art.5 ORDER CONFIRMATION
The customer declares to have read and accepted these general terms and conditions of sale before placing his order. Validation of his order therefore constitutes acceptance of these General Terms and Conditions of Sale.
Unless proven otherwise, the data recorded by PARICI constitutes proof of all transactions made by PARICI and its customers.
Art.6 AVAILABILITY
Product offers and prices are valid as long as they are visible on the site, within the limit of available stocks. The customer declares to have read and accepted these general conditions of sale before placing his order. Validation of his order therefore constitutes acceptance of these General Conditions of Sale.
Art.7 PAYMENTS
Payment is due upon ordering. The latter is only processed upon receipt and validation of the payment, which must be made by credit card via the secure payment module by the LCL bank. The customer's banking information is never communicated to PARICI, but processed directly by the bank's secure and encrypted server, Sherlock's. It is also possible to pay for your order by bank transfer, which results in longer order processing times.
Art.8 DELIVERY
Delivery is made to the address that the customer will have indicated when ordering. From the date on which the ordered products leave our warehouses, PARICI can no longer be held responsible for delays or damage caused during transport. Delivery times are given for information purposes only. All our shipments are made by La Poste by priority delivery, by Colissimo or by Chronopost depending on the service provider adapted to the destination of the package and depending on the choice of service provider made by the customer. In the event of an unexpected stock shortage or one not reported on the page of the article by mistake, for an ordered article, the customer will be notified immediately by PARICI customer service, in order to inform them of the possible delay and allow them, if necessary, to cancel their order and obtain an immediate refund of the sums already paid.
Art.9 COMPLAINT, WITHDRAWAL PERIOD
The customer has a withdrawal period of 7 days to cancel his order after receipt of it (return of the items in their original packaging in new condition, accompanied by the original invoice and a bank details form). After this period, no refund or return of goods can be considered without prior agreement. The cost of returning the products is the responsibility of the customer (except in the event of an error on our part: incorrect reference, data entry error). No goods returned with postage due can be received by our After-Sales Service. Any return request, including within the legal withdrawal period, must be submitted to PARICI in writing (e-mail or mail) for acceptance.
Art.10 RETENTION OF TITLE
PARICI reserves ownership of the goods sold, delivered and designated on its invoices until their effective and full payment (application of law n° 80-3355 of May 12, 1990). In the event of disagreement on the terms of restitution of the products following a payment incident, this may be obtained by interim order issued by the President of the Paris Commercial Court to which the parties expressly attribute jurisdiction. The costs incurred by the need for recovery in litigation remain the responsibility of the customer (including the fees of ministerial officers and interest for late payment).
Art.11 DATA PROTECTION AND FREEDOM
In accordance with Law No. 78-17 of 6 January 1978 relating to data processing, files and freedoms, the processing of personal information collected on the site has been declared to the National Commission for Data Protection and Liberties. The user has the right to access, modify, rectify and delete data concerning him/her. To exercise this right, the user must send an e-mail to the following address: remi@souvenirparis.com.
Art.12 JURISDICTION, DISPUTE
Customers who order via the PARICI website (www.souvenirparis.com) in French are deemed to be purchasing in France and are therefore subject to French law. The courts of Paris will have sole jurisdiction in the event of a dispute of any nature or dispute over the order. This clause applies even in the event of summary proceedings, incidental claims or multiple defendants.
